How We Approach Each Matter
Initial Enquiry
We review the details you provide and confirm whether the matter falls within our scope of practice. We are straightforward about what we can and cannot assist with.
Engagement & Document Review
We agree scope and fees in writing. We then review the relevant documents — scheme rules, contribution records, correspondence with administrators — and form our assessment.
Advice or Representation
Depending on the engagement, we provide a written legal opinion or proceed with representation. We keep clients informed throughout and discuss any material developments before acting on them.
Pension Entitlement Review
A considered review of your pension entitlement, including contribution records, statutory provisions applicable to your situation, and correspondence with pension administrators. Appropriate where you believe your pension benefit has been incorrectly calculated, where a dispute has arisen with the administrator, or where you wish to understand your position before taking further steps.
- Written legal opinion summarising findings
- Recommended next steps provided in writing
- Contribution record and statutory provision analysis
- No obligation to proceed to further representation
- Completed within an agreed timeframe
Representation in Dispute Proceedings
Representation in disputes with pension administrators or employers concerning entitlement calculations, benefit denials, survivor claims, or employer contribution failures. Work typically includes correspondence, negotiation, and where necessary, representation in civil proceedings or before statutory tribunals. The scope is agreed with the client at engagement and revisited as matters develop.
- Legal correspondence and negotiation
- Civil proceedings representation
- Statutory tribunal representation where applicable
- Scope and fees agreed in writing at engagement
- Regular case progress updates provided
Estate and Survivor Benefit Matters
Attention to matters involving deceased pension members and survivor entitlements. Work includes review of scheme rules regarding dependency and survivor benefits, documentation of entitlement for surviving spouses or children, and assistance with administrator applications. Also covers disputes where administrators have declined survivor benefits.
- Scheme rule review for dependency and survivor benefits
- Entitlement documentation for spouse or children
- Administrator application assistance
- Disputes over declined survivor benefits
- Initial consultation included to determine appropriate path
