The Challenge

A client in their early sixties had taken voluntary separation from a large employer and was told their occupational pension entitlement was substantially lower than they had anticipated. The scheme administrator provided only a summary calculation with no supporting detail.

Our Work

We obtained and reviewed the scheme trust deed and the client's contribution records over a twenty-three year employment period. The review identified that the administrator had applied a benefit formula appropriate to post-amendment members, not to the client's earlier joining date.

The Outcome

Following our correspondence with the scheme administrator, the calculation was revised. The corrected benefit was approximately 28% higher than the original figure. The matter concluded within four months without civil proceedings. Duration: 4 months.

The Challenge

A surviving spouse of a pension scheme member had applied for survivor benefits and was declined on the basis that the scheme rules required financial dependency to be demonstrated. The administrator's letter cited a clause in the scheme deed that the client had not seen.

Our Work

We reviewed the full scheme deed and identified that the dependency clause had been amended in 2019, but that the amendment had not been communicated to members as required by the scheme rules. We prepared a formal representation on behalf of the client addressing both the substantive and procedural grounds.

The Challenge

A client had received EPF statements showing consistent contributions from their employer over an eleven-year period, but on reviewing the records more carefully believed that contributions had been understated relative to their actual monthly salary during that period.

Our Work

We reviewed payslip records against EPF contribution statements and identified a recurring discrepancy in the employer's contribution rate. We filed a formal complaint with the EPF on behalf of the client with supporting documentation and a legal analysis of the relevant statutory obligation.

The Outcome

The EPF directed the employer to make good the shortfall with applicable interest. The total correction to the client's account represented several years of underpayment and a meaningful addition to their retirement savings. Duration: 8 months.
